Terms of Service

1. Agreement and authority
These Terms govern your use of ALIGN, provided by TransformationLink, LLC ("TransformationLink", "we", "us"). By using the service, you agree to these Terms. If you use ALIGN for an organization, you represent that you are authorized to act for it; "you" includes that organization as applicable. A separate signed agreement controls where it expressly conflicts with these Terms. If you do not agree, do not use the service.
2. Accounts and access
You must be at least 18 and able to enter a binding agreement. Provide accurate account information, protect credentials and notify us of suspected misuse. You are responsible for activity under your account and for authorizing members, integrations and agents. Organization, workspace and project roles determine access. Administrators may change membership or permissions; leaving an organization does not give you ownership of its shared content.
3. Permitted use
Use ALIGN only for lawful purposes and within applicable subscription limits. Do not access data without authorization, evade security or limits, interfere with the service, distribute malicious code, infringe intellectual property or privacy rights, or use the service to harass or unlawfully discriminate. Do not upload content you lack permission to share. We may investigate misuse and restrict access where reasonably necessary to protect the service or others.
4. Your content
You retain your rights in content you submit. You grant TransformationLink and its service providers the limited permissions necessary to host, process, display, transmit, back up and otherwise use that content to provide and secure the service and perform features you request. You are responsible for the accuracy, legality and permissions of your content, including personal data about stakeholders. Sharing and exporting content must comply with your organization’s policies and applicable law.
5. ALIGN intellectual property
The ALIGN service, framework materials, software, design and branding remain the property of TransformationLink or its licensors. Subject to these Terms and your applicable subscription, you may use the service and provided materials for authorized business purposes. No ownership transfer or broader license is implied. Customer-content rights remain as described above.
6. AI assistance and professional judgment
AI outputs are drafts and suggestions, not verified facts, approvals or professional advice. They may be inaccurate, incomplete or unsuitable, including statements about people, risks, dates or results. Review and correct outputs before relying on, sharing or implementing them. You remain responsible for decisions and for obtaining legal, employment, financial, security or other professional advice where needed. ALIGN does not guarantee adoption outcomes, project success, savings or regulatory compliance.
7. Third-party services
Optional integrations, AI services, presentation tools, connected agents and external links may transfer content to third parties at your request. Those services have their own terms and privacy practices, and may change or become unavailable. You are responsible for granting appropriate permissions and reviewing their suitability. We do not control third-party sites or guarantee their availability or outputs.
8. Trials, subscriptions and commercial terms
Access, trial duration and usage limits depend on the plan or offer provided to you. Trial access may become restricted when the trial ends. Prices, payment schedules, renewal, cancellation and any refund rights are governed by the applicable offer, order or separate agreement and mandatory law; these Terms do not create an undisclosed automatic renewal or payment obligation. 9. Availability and changes
We may improve, change or discontinue features and perform maintenance. We do not promise uninterrupted or error-free access unless a separate agreement provides otherwise. Keep appropriate copies of important content using available exports. Where reasonably practicable, we will provide notice of material changes that affect an active paid arrangement, subject to security and legal needs.
10. Suspension and termination
You may stop using ALIGN and request account closure through info@transformationlink.com. Organization administrators may remove access. We may suspend or terminate access for material violations, nonpayment under agreed commercial terms, security risks or legal requirements. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue. Data handling after closure is subject to the Privacy Policy, applicable agreements and law; project archiving is not deletion. Obligations intended to survive termination continue.
11. Disclaimers
To the extent permitted by applicable law, ALIGN is provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service or AI outputs will be accurate, complete or meet every requirement. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by applicable law, TransformationLink will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or business opportunities arising from use of the service. Except where a separate agreement provides otherwise, our aggregate liability for claims related to the service will not exceed the fees paid or payable to TransformationLink for the affected service in the 12 months preceding the event giving rise to the claim. These limits do not apply where prohibited by law, including liability that cannot lawfully be limited, and do not override mandatory consumer rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, except where mandatory applicable law requires otherwise. Contact us first so we can try to resolve a concern in good faith. These Terms do not require arbitration or waive rights that cannot lawfully be waived.
14. General terms and contact
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. We may update these Terms with notice as appropriate; changes apply prospectively subject to applicable agreements and law.
